# Acceptable Use Policy

This Acceptable Use Policy (the “AUP”) explains the standards that apply when using services provided by Elements Platform Ltd. (“Elements Hosting”, “us”, “our”). It applies to the use of our websites, portals, applications, hosted environments, infrastructure, support systems, and related services (together, the “Services”) by customers, account holders, administrators, resellers, end users, and any other person who accesses or uses the Services through an Elements Hosting account (collectively, “you” and “your”). The Services may be used only for legitimate purposes and in a way that is consistent with this AUP, the applicable agreement for the Services, and any related terms published by Elements Hosting.

This AUP provides examples of prohibited conduct, but it does not list every form of misuse. Elements Hosting may update this AUP by posting a revised version, and continued use of the Services after any update means you accept the revised policy. You are responsible for your own use of the Services and for ensuring that your employees, contractors, customers, and end users comply with this AUP. If this AUP is breached, Elements Hosting may investigate the matter and may restrict, suspend, or terminate access to the Services or the relevant account where appropriate.

## Illegal, harmful, and offensive use

The Services must not be used for unlawful, harmful, fraudulent, infringing, abusive, or otherwise objectionable activity. You must not use the Services to create, store, display, transmit, distribute, or make available content that is illegal, harmful, fraudulent, infringing, or offensive.

This includes, for example:

* Activity that is illegal, tortious, deceptive, or that violates the rights, safety, or property of others.
* Fraudulent or deceptive schemes such as phishing, pharming, impersonation, sham offers, Ponzi schemes, pyramid schemes, or similar scams.
* Child sexual abuse material, sexual exploitation content, non-consensual sexual content, bestiality-related content, or any other material that is unlawful or harmful to minors.
* Content that is defamatory, obscene, abusive, threatening, discriminatory, harassing, invasive of privacy, deliberately misleading, or that promotes hatred, racism, misogyny, violence, or religious intolerance.
* Content or activity that infringes intellectual property rights, privacy rights, publicity rights, confidentiality obligations, or other proprietary rights.
* Malicious code or harmful software, including viruses, worms, Trojan horses, cancelbots, time bombs, or any tool intended to damage, disrupt, intercept, or expropriate systems, services, or data.
* False identity claims, impersonation, or misrepresentation of affiliation, authority, qualifications, or source.
* Unauthorized resale or redistribution of the Services where prior written approval is required.

## Spam and communications abuse

You must not use the Services to send, publish, distribute, relay, or facilitate unsolicited bulk communications, including spam email, mass marketing messages, unsolicited promotions, or similar abusive campaigns. You must not falsify or obscure message headers, routing details, or sender identity, and you must not collect responses to messages that violate this policy or another provider’s acceptable use rules.

Forums, messaging systems, feeds, ticketing tools, and any other communication features made available through the Services must not be used to promote unrelated businesses, services, or opportunities unless Elements Hosting has expressly approved that use.

## Security violations

You must not use the Services to interfere with or compromise the security or integrity of any network, computer system, device, application, or communications environment without authorization. Any attempt to breach, test, or evade security controls without permission is prohibited.

Examples include:

* Accessing systems, accounts, applications, or data without authorization.
* Probing, scanning, or testing vulnerabilities without the permission of the owner or operator of the target system.
* Intercepting, monitoring, or capturing network traffic or data without authorization.
* Forging packet headers, email headers, or other technical identifiers relating to the origin or route of communications.

## Network abuse and service misuse

You may communicate only with users, hosts, systems, and networks where you have permission to do so. The Services must not be used in a way that disrupts, degrades, overloads, or unfairly consumes infrastructure, or that causes harm to other customers, providers, or third parties.

Prohibited conduct includes:

* Monitoring, crawling, scraping, or similar activity that impairs the operation of a target system.
* Denial-of-service attacks, distributed denial-of-service attacks, flooding, mail bombing, broadcast attacks, or any deliberate attempt to overwhelm a service or reduce its availability.
* Operating open proxies, open mail relays, open recursive DNS resolvers, or other exposed services that facilitate abuse.
* Using manual or automated methods to bypass account restrictions, service limits, access controls, or storage controls.
* Excessive or abusive consumption of compute, network, or other shared resources in a way that affects platform stability or the experience of other users.

Where resource usage is unusually high but not otherwise prohibited, Elements Hosting may apply reasonable technical controls or request corrective action in order to maintain reliable performance across the platform.

## Compliance obligations

You must comply with this AUP and with all laws, regulations, and regulatory requirements that apply to your use of the Services. This includes, where relevant, laws relating to privacy, data protection, intellectual property, exports, taxation, telecommunications, consumer protection, and sector-specific compliance obligations. All use of the Services must be professional, responsible, and consistent with their intended purpose.

## Monitoring and enforcement

Elements Hosting may investigate suspected misuse of the Services or any violation of this AUP. To protect the platform, customers, third parties, and the public, Elements Hosting may review relevant reports and technical information, remove or disable access to content, require remediation, impose restrictions, suspend access, or terminate Services or accounts as appropriate.

Elements Hosting may also preserve, use, or disclose relevant information where reasonably necessary to investigate abuse, address security issues, prevent fraud, enforce contractual rights, comply with legal obligations, protect rights or property, or cooperate with law enforcement, regulators, courts, or other appropriate authorities.

Nothing in this AUP obliges Elements Hosting to monitor every activity or retain content after Services have ended. Elements Hosting may act immediately, including without prior notice, where prompt intervention is reasonably necessary.

## Examples of prohibited activities

Without limiting the general rules above, the following activities are prohibited when using the Services:

* Operating unlawful contests, unlawful lotteries, illegal gambling activities, chain letters, junk messaging, or pyramid-style schemes.
* Defaming, stalking, harassing, abusing, threatening, or otherwise violating the legal rights of others, including rights of privacy and publicity.
* Publishing, storing, or distributing unlawful obscene content or other illegal material, including child sexual abuse material or virtual child sexual abuse material.
* Publishing or disseminating material that incites hatred, discrimination, violence, or terrorism against any individual or group.
* Uploading, sharing, or distributing software, images, documents, or other material without the rights, licenses, or permissions required to do so.
* Using any content made available through the Services in a way that infringes copyright, trademark, patent, trade secret, privacy, publicity, or other legal rights.
* Uploading or distributing corrupted files, malware, or other harmful code.
* Downloading or redistributing material that you know, or reasonably should know, cannot lawfully be distributed in that manner.
* Removing, altering, or falsifying authorship notices, proprietary notices, legal notices, or source identifiers.
* Restricting or interfering with another user’s ability to use and enjoy the Services.
* Harvesting or collecting information about others, including email addresses, except where genuinely necessary to operate a lawful service and permitted under applicable privacy requirements.
* Creating false identities or deceptive profiles for the purpose of misleading others.
* Hosting TOR exit nodes.
* Selling, sharing, or otherwise providing user directories, usage data, or account-related information obtained through the Services unless expressly authorized.
* Carrying out network probing or port scanning without explicit authorization from the owner or operator of the destination host or network.
* Using bots or automated systems to acquire goods, inventory, tickets, or similar items in a way that breaches third-party terms or causes Elements Hosting IP ranges or upstream infrastructure to be blocked or restricted.
* Operating autodialers, robocalling systems, or similar VoIP-based mass-calling tools.
* Using the Services to offer denial-of-service or distributed denial-of-service mitigation as a service where that use creates abuse or upstream risk for the platform.
* Using the Services for CPU or GPU cryptocurrency mining.

## Reporting violations

If you become aware of a violation of this AUP, you must notify Elements Hosting promptly and provide reasonable assistance, where requested, to help stop or remedy the issue. Reports concerning spam, abuse, unlawful content, attacks, or other suspected violations should be sent to <abuse@elementsplatform.com>.
